These Terms of Service (“Terms”) govern your use of the UpwardJournal mobile application (“App”) provided by:

By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
UpwardJournal is a personal journaling and goal-tracking app for iOS. The App allows you to:
The App stores data locally on your device and, if iCloud is enabled, syncs data to your personal iCloud account via Apple’s CloudKit private database.
The App offers core functionality for free. Additional premium features are available through a paid subscription or a one-time lifetime purchase.
Premium subscriptions are available in the following periods:
Current prices are displayed in the App and in the Apple App Store. Prices include applicable taxes as determined by Apple based on your region.
If a free trial or introductory offer is available, your subscription will automatically renew at the standard subscription price at the end of the trial or offer period, unless cancelled at least 24 hours before the trial or offer ends. Unused portions of a free trial are forfeited upon purchasing a subscription.
We may change subscription prices. Price changes take effect at the start of the next billing period following the date of the price change. Your continued use of the premium features after the price change constitutes acceptance.
You agree to use the App only for lawful purposes. The App is designed for personal journaling and self-improvement. You are solely responsible for the content you create within the App.
The App, including its design, code, graphics, icons, and user interface, is the intellectual property of Hendrik Heim and is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App.
You retain full ownership of all content you create in the App (journal entries, goals, reflections, vision statements, letters, and all other user-generated text). We claim no rights to your content. Your content is stored on your device and in your personal iCloud account only.
Your use of the App is also governed by our Privacy Policy. Key points:
We strive to keep the App available and functional, but we do not guarantee uninterrupted access. The App’s functionality depends on your device, iOS version, and (for sync features) your iCloud account and internet connection.
We may release updates that modify, add, or remove features. Continued use of the App after an update constitutes acceptance of any changes. Updates are distributed through the Apple App Store.
We reserve the right to discontinue the App at any time. In such case, we will provide reasonable notice. Your locally stored data remains on your device regardless of app discontinuation.
The App is a personal productivity and journaling tool. It does not provide medical, psychological, therapeutic, or professional advice. If you experience mental health concerns, please consult a qualified professional.
The App is provided “as is” and “as available” without warranties of any kind, to the extent permitted by applicable law. We do not warrant that the App will be error-free, uninterrupted, or suitable for any particular purpose.
To the extent permitted by applicable law:
These limitations do not apply to liability for willful misconduct or gross negligence, or where limitation of liability is prohibited by applicable law.
You agree to indemnify and hold harmless Hendrik Heim from any claims, damages, or expenses arising from your misuse of the App or violation of these Terms.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions remain in full force and effect. The invalid provision shall be replaced by a valid provision that achieves the economic purpose of the original provision as closely as possible.
We may amend these Terms by posting updated Terms at this URL. Material changes will be communicated through a notice in the App. Continued use after changes constitutes acceptance.
These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer residing in the EU, you also benefit from the mandatory provisions of your country of residence.
The exclusive place of jurisdiction for all disputes is Hanau, Germany, to the extent permitted by law. For consumers, the jurisdiction of the consumer’s place of residence applies.
The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr. We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

Die App speichert Daten lokal auf Ihrem Gerät und synchronisiert sie bei aktiviertem iCloud mit Ihrem persönlichen iCloud-Konto.
Die App bietet Kernfunktionalität kostenlos an. Zusätzliche Premium-Funktionen sind über ein kostenpflichtiges Abonnement oder einen einmaligen Lifetime-Kauf verfügbar.
Aktuelle Preise werden in der App und im Apple App Store angezeigt.
Falls eine kostenlose Testphase verfügbar ist, verlängert sich Ihr Abonnement am Ende der Testphase automatisch zum regulären Preis, sofern es nicht mindestens 24 Stunden vor Ablauf gekündigt wird.
Wir können Abonnementpreise ändern. Preisänderungen werden zu Beginn des nächsten Abrechnungszeitraums wirksam. Die fortgesetzte Nutzung der Premium-Funktionen nach der Preisänderung gilt als Zustimmung.
Sie verpflichten sich, die App nur für rechtmäßige Zwecke zu nutzen. Sie sind allein verantwortlich für die Inhalte, die Sie in der App erstellen.
Die App, einschließlich Design, Code, Grafiken, Icons und Benutzeroberfläche, ist geistiges Eigentum von Hendrik Heim. Sie dürfen keinen Teil der App kopieren, modifizieren, verbreiten, verkaufen oder lizenzieren.
Sie behalten das vollständige Eigentum an allen in der App erstellten Inhalten. Wir beanspruchen keine Rechte an Ihren Inhalten.
Ihre Nutzung der App unterliegt auch unserer Datenschutzerklärung. Kernpunkte:
Wir bemühen uns, die App verfügbar und funktionsfähig zu halten, garantieren aber keinen ununterbrochenen Zugang.
Wir können Updates veröffentlichen, die Funktionen ändern, hinzufügen oder entfernen. Die fortgesetzte Nutzung der App nach einem Update gilt als Zustimmung.
Wir behalten uns das Recht vor, die App jederzeit einzustellen. Ihre lokal gespeicherten Daten verbleiben unabhängig davon auf Ihrem Gerät.
Die App ist ein persönliches Produktivitäts- und Journaling-Werkzeug. Sie bietet keine medizinische, psychologische oder therapeutische Beratung.
Die App wird “wie besehen” ohne jegliche Gewährleistung bereitgestellt, soweit dies nach geltendem Recht zulässig ist.
Diese Beschränkungen gelten nicht für die Haftung bei Vorsatz oder grober Fahrlässigkeit.
Sie erklären sich bereit, Hendrik Heim von allen Ansprüchen freizustellen, die aus Ihrer missbräuchlichen Nutzung der App entstehen.
Sollte eine Bestimmung für unwirksam gehalten werden, bleiben die übrigen Bestimmungen in vollem Umfang wirksam.
Wir können diese Bedingungen durch Veröffentlichung aktualisierter Bedingungen unter dieser URL ändern. Die fortgesetzte Nutzung nach Änderungen gilt als Zustimmung.
Diese Bedingungen unterliegen dem Recht der Bundesrepublik Deutschland unter Ausschluss des UN-Kaufrechts (CISG). Ausschließlicher Gerichtsstand ist Hanau, Deutschland. Für Verbraucher gilt der Gerichtsstand des Wohnsitzes.
